The goal of the Capital One® Race for Kids™ is for participants and teams to enjoy themselves while taking part in a unique national fundraising event for Boys and Girls Clubs of Canada. This adventure race will allow participants to return to the best adventures of their childhood, to embrace the carefree days of being a kid, and to bond as a team as they challenge their skills while raising funds for all boys and girls to have the same opportunity. Participants are required to abide by the Rules and Regulations of the event provided below.

The Event and each Race (as defined below) are administered by Boys and Girls Clubs of Canada. There is a suggested registration fee of between $10 to $50 per participant, as determined by each Local Club (as defined below). In addition, to be eligible to win a Race and to receive Race-related prizes, each team must have raised and contributed to the Capital One Race for Kids event registration site a minimum suggested fundraised amount between $360 and $500. The exact amount of the suggested registration fee and suggested fundraising amount for each Race will be published on the website of each Local Club no later than January 6, 2016. See Sections 11 through 15 for further details and for how to register and be eligible to win prizes without paying this fee and raising the suggested fundraising amount. Each Local Club will have the option of administering a random draw for additional prizes.  See Section 20 for more details about random draws, and see Sections 19 and 21 for further information on how to be eligible to win additional fundraising-based prizes.

RULES & REGULATIONS
All Provinces excluding Quebec

1. Date, Time, and Location of Race. The Capital One Race for Kids will take place on one of the following dates: May 21, 2016; May 28, 2016; June 4, 2016; or June 11, 2016 (each, an “Event Day”) in various cities and towns across Canada (excluding the province of Quebec) where the local Boys and Girls Clubs of Canada chapter (each, a “Local Club”) is promoting the race (each being a “Race”).  The specific date, time and location of each Race will be published on the website of each Local Club no later than January 6, 2016. On Event Day, each Local Club may hold a random draw for Prizes specific to the Local Club’s Race, as further described under Section 20 below (each being a “Random Draw”). Additional fundraising-based prizes may be awarded, as further described under Section 21 below. Throughout these Rules and Regulations, the Races, any applicable Random Draws and any applicable fundraising-based prize selections or draws are referred to collectively as the “Event”, and prizes awarded to the winner(s) of or participants in a Race, to winner(s) of a Random Draw (where applicable), and to winner(s) of fundraising-based prizes are referred to as “Prizes”.

2. Checkpoint Challenges. Each Race consists of 10-15 tasks at a specified locations (each, a “Checkpoint Challenge” or “Challenge”), of which each team of four validly registered and eligible Race participants (a “Team”) must complete at least 10 (including any Challenges specified to be mandatory Challenges) prior to crossing the finish line. Teams must decipher a clue (a “Checkpoint Clue”) to determine the location of each Checkpoint Challenge. Checkpoint Challenges may consist of a small puzzle or task that each Team will need to successfully complete, as determined by the Capital One Race for Kids official(s) (each, an “Official”) present at each Challenge, in order to receive a token certifying completion of the Challenge (a “Checkpoint Token”). In order to win a Race, all 4 Team members must be the first to reach the finish line with at least 10 Checkpoint Tokens in hand (including all Checkpoint Tokens from any Challenges specified to be mandatory Challenges) and must have correctly solved the Capital One Race for Kids Final Puzzle (the “Final Puzzle”).

3. Tie-Breakers. In the case of a tie at the conclusion of a Race, an Official may assign a tie-breaking challenge to the tied Teams. The winner of any tie-breaking challenge (as determined by the Official in their sole and absolute discretion) will be the winner of the tie and of the applicable Race.

4. Travel. Travel in the course of a Race is only permitted by foot or public transit. Teams are not permitted to use any alternative mode of transportation during a Race. The only exception to this rule is if a Local Club event organizer explicitly designs a Checkpoint Challenge to include operation of a vehicle, in which case the Team shall be permitted to utilize alternative methods of transportation solely for the purpose of completing, or attempting to complete, such Challenge. Teams must stay together at all times during a Race and must complete each Challenge as a team unless otherwise instructed by an Official.    

5. Race Bibs. Participants must wear any official Capital One Race for Kids bib numbers at all times (unless instructed otherwise by the Officials) in such a way that it, and any printing on it, is visible at all times.

6. Checkpoint Challenges. All four members of a Team must be present at the Checkpoint Challenge location before beginning the Challenge.  If there is more than one Team at a Checkpoint Challenge location, the teams will complete the Challenge on a first-come, first-served basis. An exception will be made in the event that a Team has a Race Advantage as further described in Section 10.

7. Assistance. Participants may not accept physical help, transportation, assistance, support, guidance and/or contributions of any kind towards the completion of a Race, individual Checkpoint Challenges, and the Final Puzzle from any persons other than their Team members, or as expressly permitted in these Rules & Regulations or by an Official.

8. Issues with Challenges. The Releasees (defined below) will not be held responsible for any Checkpoint Challenge deemed to be offensive to Teams or participants. Failure to participate in any Checkpoint Challenge will result in the Team being required to sit out a time penalty or disqualification from a Race, as determined by the Official in their sole and absolute discretion. In the event a Checkpoint Challenge experiences a technical, mechanical or other issue that prevents the completion of the Challenge by any Team, the Official may, in their sole and absolute discretion, require a Team to sit out a time penalty as substitute for completion of the Challenge.

9. Participant Conduct. All participants must obey all laws, regulations, bylaws and rules of the road and comply with the directions of the Officials, authorities and property/venue owners. The Releasees (defined below) are not responsible for the actions of participants during the course of a Race.

RACE ADVANTAGES

10.  There are three types of race advantages that Teams may earn: a Checkpoint Bypass Card, a Head Start or a Final Puzzle Clue (each a “Race Advantage”). The Race Advantage(s) available at each Race may vary, and will be published on the website of each Local Club no later than March 1, 2016. Teams may be provided with a card evidencing their receipt of a Race Advantage. Race Advantage cards must be kept in the possession of each Team for the duration of a Race or until surrendered at a Checkpoint Challenge. In addition, each Local Club may offer additional benefits before, during or after a Race to Teams that achieve a certain fundraising target (“VIP Benefits”), provided that VIP Benefits shall not confer an advantage on any team in completing or winning a Race. Eligibility and benefit of each Race Advantage and VIP Benefits are as follows:

10(a) Checkpoint Bypass Card
Eligibility:  Each Team achieving a team fundraising target of $1,000 will be awarded a Checkpoint Bypass Card.

Advantage:  An Official will allow a Team that presents a Checkpoint Bypass Card to advance to the front of the line at any one Checkpoint Challenge location. Teams must relinquish their card to the Official at that location to use this Race Advantage.  If one Team holding a Checkpoint Bypass Card arrives at a particular Checkpoint Challenge location while another Team with a Checkpoint Bypass Card is already there and both Teams attempt to use their Checkpoint Bypass Card at that particular location simultaneously, the Teams will advance to the front of the line in the order they arrived at the Checkpoint Challenge location. For example, if two Teams arrive at a Checkpoint Challenge location and both Teams attempt to utilize their Checkpoint Bypass Card, the second Team to have all four Team members arrive at the Checkpoint Challenge location will not be allowed to proceed ahead of the first Team who arrived at the Checkpoint Challenge location and used a Checkpoint Bypass Card.

10(b) Head Start

Eligibility: One Head Start will be given to Teams for reaching specific fundraising targets. The range of fundraising targets for each Head Start are set out below; the specific fundraising targets to earn a Head Start for each Race will be published on the website of each Local Club no later than March 1, 2016.

I.    $750 or $1,000 fundraised dollars = 1 minute    
II.    $1,000 or $1,500 fundraised dollars = 3 minutes
III.    $1,500 or $2,000 fundraised dollars = 5 minutes

Advantage:  At the start of each Race, teams meeting the minimum fundraising targets as provided on the website of each Local Club will be given a corresponding head start on such Race. Head Starts are not cumulative, and each team is limited to using only one Head Start during each Race.

10(c) Final Puzzle Clue
Eligibility: Teams meeting a minimum fundraising target of $1,000 will be given a Final Puzzle clue.

Advantage: At the end of each Race, the clue may help Teams solve the Final Puzzle.

10d) VIP Benefits

Eligibility: Teams meeting a minimum fundraising target of $2,500 will receive VIP Benefits on the Event Day. VIP Benefits shall be determined at the sole discretion of the Local Club for each Race, and may include, but are not limited to, the following:

I.    Access to an exclusive VIP lounge at the location of the Race;
II.    Access to a separate VIP registration area prior to the Race;
III.    Enhanced and/or free food options for Team members;
IV.    Race-related accessories, such as sun visors or bandanas;
V.    Customized Race jerseys;
VI.    Acknowledgement of teams that have achieved the VIP Benefits fundraising target during speeches and presentations;
VII.    Receipt of, or eligibility to win, a special trophy designated for Teams that have achieved the VIP Benefits fundraising target; and
VIII.    Complimentary alcoholic beverages at a Race after-party.

The approximately retail value of VIP Benefits for each eligible Team will be $100. Actual VIP Benefits available at each Local Club will be published on the website of each Local Club no later than March 1, 2016.

Advantage: VIP Benefits shall confer no advantage to Teams in completing or winning a Race.

HOW TO REGISTER

11. Eligibility Requirements and Registration Donation. To be eligible to participate in a Race, participants must be a legal resident of Canada (excluding the province of Quebec), and must be eighteen (18) years of age or older on the Event Day. All participants must agree to and submit an Assumption of Risks, Waiver of Claims, Release and Indemnification Agreement (“Release”) to Boys and Girls Clubs of Canada. The Release is made available to participants at the time of registration, and must be agreed to and submitted at that time. Any participants who are eighteen years old and who reside in a jurisdiction where nineteen (19) years of age is the age of majority will be required to have a parent or legal guardian submit a signed copy of the Release on their behalf. Participants must register as a Team of four (4) eligible participants. If any member of a Team is absent on Event Day, the remaining Team members may still participate in a Race, but will be ineligible to win any Race-related Prizes. Alternatively, if a Team member is absent on Event Day, a Team may substitute in a new Team member, provided that (i) such substitute Team member must be eligible to participate in the Race, subject to the eligibility requirements set out above, and (ii) such substitute Team member must submit a signed copy of the Release to Boys and Girls Clubs of Canada prior to participating in the Race. Participants must raise and submit a combined non-refundable registration fee of $40-$200 per Team ($10-$50 per Team member), or each participant must submit a No Purchase Registration as described below. Registration must be submitted using the Boys and Girls Clubs of Canada website and all registrations must be complete by at least one hour before the applicable Race starts (in your local time zone), or by 12:00:01 pm (in your local time zone) on May 14, 2016 in the event of a No Purchase Registration, to be eligible to participate in the Race. Teams that substitute a new Team member will not be required to submit an additional registration fee or an additional No Purchase Registration as described below for the substitute Team member, provided that the original Team member who is being substituted has previously completed such registration. Teams that include substitute Team members will continue to be eligible to win Race-related Prizes.

12. No Purchase Registration. To register to participate in a Race without submitting a registration donation or raising the minimum fundraising amount (as detailed in Section 15(a) below), each member of a Team may submit a unique and original minimum 100 word essay on the subject of “The importance of the services provided by the Boys and Girls Clubs of Canada”.  The essays may be mailed or hand delivered to the Local Club or emailed to raceforkids@bgccan.com.  All essays must be received no later than 12:00:01 pm (in your local time zone) on May 14, 2016.

13. Promotional Codes. The Boys and Girls Clubs of Canada may in its sole and absolute discretion, publish a promotional code or codes, which offer participants the opportunity to register for a Race with a reduced or waived registration fee.  In the event this option is exercised, the effect of the promotional code, the conditions associated with its use, and the deadline for registering using it will be published with the promotional code. A promotional code must be submitted at the time the participant registers to be valid. Any participant that registers using a promotional code or codes shall not be entitled to a refund or credit in the event another promotional code is published or otherwise made available that reduces or waives the registration fee in any amount greater than the original promotional code used by such participant when they registered for a Race. In order to win a Race or be eligible to receive any Race-related Prizes, teams with participants making use of a promotional code must have raised and contributed to the Capital One Race for Kids event registration site the minimum suggested fundraising amount specified in section 15(a) below. 


14. No Refund. Any donations made to a Team (and donations made by such Team members) that chooses not to compete in a Race, does not raise the minimum suggested amount and submit the required registration fee, or does not register via the No Purchase Registration option, or a team disqualified under these Rules & Regulations, will not be eligible for refunds.

15. Prize Eligibility. To be eligible to win a Race and receive Race-related Prizes:

(a) the Team must have raised and contributed to the Capital One Race for Kids event registration site a minimum suggested fundraised amount between $360 and $500 (in addition to the registration fee  detailed above). The exact minimum suggested fundraised amount for each Race will be published on the website of each Local Club no later than January 6, 2016. Alternatively, the Team must have submitted a No Purchase Registration as described above; 

(b) all four (4) Team members must be present and have participated in the Race from the start line to crossing the finish line and completing the Final Puzzle;

(c) the Team must present 10 Checkpoint Tokens (including all Checkpoint Tokens from any Challenges specified to be mandatory Challenges);
(d) the Team must be confirmed by the event Officials as having completed at least 10 Challenges (including any Challenges specified to be mandatory Challenges); and

(e) the Team must solve the Final Puzzle within the duration of the applicable Race.

DISQUALIFICATION FROM RACE

16. Disqualification. The Boys and Girls Clubs of Canada and the Officials reserve the right to disqualify any Team or participant engaging in any behaviour contrary to these Rules & Regulations. This includes Teams or participants that are acting in unsportsmanlike or illegal behaviour, are endangering their personal safety and well-being, or the safety and well-being of competing Teams or the general public, all as determined by the Officials in their sole and absolute discretion. If a participant is disqualified, their entire Team will also be disqualified and will not be permitted to continue competing in the applicable Race, or be eligible to receive any Race-related Prizes.

17. Confidential Knowledge. In the sole and absolute discretion of the Boys and Girls Clubs of Canada and the Officials, any person with confidential knowledge concerning a Race is NOT eligible to win that Race or to win any Race-related Prizes.

18. Amendment. Boys and Girls Clubs of Canada and the Officials reserve the right, to end, postpone or amend a Race, to amend or change these Rules and Regulations, or disqualify any participant(s), if for any reason they believe that participants or Teams may not be able to safely complete a Race, or for any other reason.

MYSTERY BOX CHECKPOINT

19. Local Clubs may offer an additional “Mystery Box” Checkpoint Challenge (a “Mystery Box Challenge”). Where offered by a Local Club, the Mystery Box Challenge is optional to participating Teams and completion of the Mystery Box Challenge is not required to win a Race or to receive any Prize other than a Mystery Box Checkpoint Prize.  Teams will be provided with a clue as to the location of the Mystery Box Challenge at the same time they are given the clues for the other Checkpoint Challenges. If they so choose, each Team has the option to make their way to the Mystery Box Challenge. Upon arrival they may complete a Challenge similar to those at each of the other Checkpoint Challenges. Upon successful completion of the Mystery Box Challenge, such Teams may take one key from a bucket filled with keys. One key in the bucket will open a locked box at the Local Club’s after-party. The Team whose key opens the lock will be awarded all the contents contained therein (subject to one Team member correctly answering the mathematical skill-testing question).  If none of the Teams’ keys opens the locked box, the prize will be forfeited.  The approximate value of the contents will be published on each Local Club’s website no later than March 1, 2016, where applicable.  Chances of winning a Mystery Box Checkpoint prize depend on the number of keys in the bucket at the applicable Race and the number of participant Teams that successfully complete the Mystery Box Challenge at that Race.   

ELIGIBILITY FOR RANDOM DRAW

20. Each Local Club has the option of conducting a Random Draw to select the winners of a Prize or Prizes, the number, description and value of which will be published on the Local Club’s website no later than March 1, 2016 (a “Random Draw”). Participants in the Capital One Race for Kids who registered for the Race by any method described in sections 11 through 13 of these Rules and Regulations are automatically entered into a Random Draw, if offered by a Local Club. There is no purchase necessary to enter. The Random Draw will occur during the course of the Race and winners will be announced at the after party.  The precise time and location of the after party will be published on the Local Club’s website no later than March 1, 2016. Chance of winning a Random Draw depends on the number of eligible participants registered with each Local Club.

PRIZES

21.  The number, value and types of Prizes available to be won for each Race, and the time and location of the announcement of the selected participants will be published on the website of each Local Club no later than March 1, 2016.  The number, value and types of Prizes available to be won for each Race may vary. Chances of winning a Race prize depend on the number, skill, and speed of the participants at each Race.

In addition, the following fundraising Prizes will be awarded following the Event:

Capital One Race for Kids 2016 National Early Registration Prize

One Team consisting of four participants will be selected from all eligible Teams for all Races by random draw to receive an National Early Registration Prize.

In order to be eligible to receive this Prize, a Team must

(a) have all four (4) Team members successfully register to participate in a Race via the methods described in sections 11 to 13 above prior to March 1, 2016 at 11:59:59 pm Local Time;

(b) raise the minimum fundraising amount of $360-$500 as further detailed in Section 15(a) above prior to March 1, 2016 at 11:59:59 pm Local Time; and

(c) attend and compete in a Race with all four Team members present.

The selected Team will be eligible to receive two (2) travel vouchers from WestJet Airlines Ltd. Each travel voucher is valid for one return trip for two people, with a maximum potential retail value of $2,900. The total retail value of the Early Registration Prize is $5,800. The voucher(s) are subject to the terms placed on them by their issuer. The voucher(s) cannot be exchanged or substituted for another prize of equal or lesser value, including cash. Chances of winning the Early Registration Prize depend on the number of eligible participant Teams registered for all Races that meet the eligibility criteria described above.

The winning team will be drawn on Monday June 13, 2016 by 5:00 p.m. EST and notified thereafter.

Capital One Race for Kids 2016 Fundraising Prize

One (1) Fundraising Prize will be awarded to the participant that raises the highest fundraising total for each Race at each Local Club by 11:59:59 pm Local Time on the day preceding the Event Day for each Race. The highest fundraising participant will be eligible to receive a travel voucher or vouchers for one flight for two people from WestJet Airlines Ltd., with a retail value of $2,500. The voucher(s) are subject to the terms placed on them by their issuer. The voucher(s) cannot be exchanged or substituted for another prize of equal or lesser value, including cash.  Chances of winning a Fundraising Prize depend on the number and fundraising skill of participants in each Race.

WINNER’S SELECTION, RELEASE & FULFILLMENT
22.  Participants who have won a Race or otherwise been selected to receive a Prize will be announced at the after party for each Race, the location and time of which will be published on each Local Club’s website no later than March 1, 2016.  Before being confirmed as a winner and awarded a Prize, selected participants must:

(a) correctly answer a time-limited mathematical skill-testing question without help, mechanical or otherwise;

(b) sign a liability and publicity release form (or have their parent/guardian sign if they are a minor in their jurisdiction of residence), in a form acceptable to Boys and Girls Clubs of Canada;

(c) provide proof of age and residency, in a form acceptable to Boys and Girls Clubs of Canada; and

(d) certify compliance with these Rules & Regulations, as applicable.

If a selected participant is not present at the after party, the Local Club, acting reasonably, will attempt to contact the selected participant at the telephone number provided on their Race registration within two (2) business days after the announcement at the after party or date of the Prize draw, whichever is later. In the event a selected participant cannot be contacted within two (2) business days, he or she will be disqualified and an alternate participant will be selected in accordance with these Rules and Regulations. Selected participants who are not present during the after party, and who are contacted successfully by the Local Club, must attend at the applicable Local Club, complete the requirements set out under this Section 22, and retrieve their Prize in person at the Local Club during the week following the announcement or notification of their eligibility to receive such Prize. 

23. Release Form. The liability and publicity release forms will be provided to the selected participant at the after party, or otherwise in person at the applicable Local Club or via electronic means if the selected participant is not present at the after party. If the liability and publicity release forms are not signed and returned within five (5) days from the time that the Local Club provides them to the selected participant, if the skill-testing question is not answered correctly or if the Prize is declined, the Prize will be forfeited.  Boys and Girls Clubs of Canada reserves the right to select another eligible participant (and the requirements above will apply to the newly selected participant) or to cancel the Prize.

24. Publicity Rights & Release. Before being confirmed the winner of any Prize, each selected participant may be asked to correctly answer a time-limited mathematical skill-testing question without any mechanical or other assistance.  By virtue of participating in a Race, or by accepting any Prize, each participant permits Boys and Girls Clubs of Canada and any Capital One Race for Kids sponsors to use their name, city of residence and photograph and/or video image in any publicity or advertising with no additional compensation. Each participant further releases Boys and Girls Clubs of Canada, Capital One Race for Kids sponsors and their respective agents, officers, directors, employees and representatives from any and all liability damages, costs, expenses and claims arising out of or related to the Race or any Prize. The Releasees (defined below) are not responsible for any distribution of any Prize between the participants on a winning Team. 

25.  Prize Details & Substitution. All dollar amounts mentioned are Canadian dollars. The winners must accept the applicable Prize as given. Prizes are not transferable.  If a winner of any Prize does not pick up the Prize on Event Day, the Prize must be picked up by the winner from the Local Club in the week following the Event.  In the event that all or any component of a Prize is unavailable, Boys and Girls Clubs of Canada reserves the right to substitute the Prize or Prize component with one of equal or greater value. Neither Boys and Girls Clubs of Canada nor any of the Releasees (defined below) will be responsible if any factors beyond its reasonable control prevent any Prizes from being fulfilled. Boys and Girls Clubs of Canada is not responsible for providing insurance, financial or tax advice.

26. Prize Conditions. Prize winners are solely responsible for all costs not expressly described as being part of the Prize. In other words, if applicable, all costs associated with taxes, fuel/currency surcharges, ground transportation, meals, beverages, room service, gratuities, merchandise, telephone calls, taxis, required or recommended travel documentation, insurance, personal expenses of any kind or nature, and any applicable overnight layover are excluded.  Any flight and hotel reservations are subject to availability, additional restrictions and blackout dates. The Releasees (defined below) are not responsible for any delay, postponement, suspension, unavailability, rescheduling or cancellation, for any reason, of any flights or hotels, and the Releasees (defined below) will not compensate the Prize winner(s) in the event of any of the above. If applicable, the Prize winner(s) must travel within one year of being declared a winner, or risk forfeiting the Prize. If applicable, the winner(s) must have all necessary documentation to permit international travel (passports, visas etc.), and may not have any barrier to entry into their country of destination, or re-entry into Canada. If a winner does not utilize any part(s) of the Prize, then any such part(s) not utilized will be forfeited in its entirety and nothing will be substituted in its place. Boys and Girls Clubs of Canada and Capital One Race for Kids sponsors reserve the right at any time to place reasonable restrictions on the availability or use of a Prize or any component thereof. By accepting a Prize, the winner(s) and any travel companions agree to waive all recourse against the Releasees (defined below) if any Prize or a component thereof does not prove satisfactory, either in whole or in part. Neither Boys and Girls Clubs of Canada nor Capital One Race for Kids sponsors will replace any lost or stolen tickets, vouchers, certificates or gift cards.

INTERRUPTIONS

27. It is expressly understood that each Race may be filmed for promotional purposes including broadcast on television. In an effort to accommodate the execution/planning/filming of the Event, it may be necessary for the Officials to (i) augment these Rules and Regulations with verbal or written instructions during the Event, (ii) delay the start of, or interrupt and restart, any given challenge, or (iii) otherwise amend or intervene in the operation of the Event or any Race. The Officials shall, in their sole and absolute discretion, make reasonable efforts to ensure that, if there is any positive or negative impact to a team’s performance caused by such amendments or interventions, such impact will be equally balanced among all teams.

ADDITIONAL TERMS & CONDITIONS

28. Compliance with Rules. Participation in the Event requires all participants to abide by these Rules and Regulations. Participants who do not comply with these Rules and Regulations may be subject to disqualification, in the sole and absolute discretion of the Officials or Boys and Girls Clubs of Canada. Boys and Girls Clubs of Canada reserves the right to disqualify any entrant whose character or conduct, if declared to be the winner, could bring the reputation of the Capital One Race for Kids, its sponsors or the Boys and Girls Clubs of Canada into disrepute. Boys and Girls Clubs of Canada reserves the right to modify the Rules and Regulations in any way at any time it deems necessary or appropriate without materially affecting the terms and conditions of the Capital One Race for Kids.

29. Amendment, Suspension and Cancellation. Boys and Girls Clubs of Canada reserves the right to withdraw, amend or suspend the Event or any Race (or to amend these Rules and Regulations) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of Boys and Girls Clubs of Canada that interferes with the proper conduct of the Event or any Race as contemplated by these Rules and Regulations. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Event or any Race in any way (as determined by Boys and Girls Clubs of Canada in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, Boys and Girls Clubs of Canada reserves the right to seek remedies and damages to the fullest extent permitted by law. Boys and Girls Clubs of Canada reserves the right to cancel, amend or suspend the Event, or any Race or to amend these Rules and Regulations, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Boys and Girls Clubs of Canada reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

30. Adjustment. Boys and Girls Clubs of Canada reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules and Regulations, to the extent necessary, for purposes of verifying compliance by any entrant with these Rules and Regulations, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of Boys and Girls Clubs of Canada, in its sole and absolute discretion, affect the proper administration of the Event as contemplated in these Rules and Regulations, or for any other reason.

RELEASE OF LIABILITY

31. Disclaimer. Boys and Girls Clubs of Canada, Capital One Bank (Canada Branch), Capital One Race for Kids sponsors, their affiliates, Prize providers and all of their directors, officers, employees, agents, as well as their respective advertising and promotional agencies (collectively, the “Releasees”) assume no responsibility for late, lost, stolen, destroyed, misdirected, illegible or otherwise indecipherable registrations, for any failure or technical malfunction of any website, telephone networks, online computer systems or equipment, servers, access providers or software, poor reception or technical problems, human error or traffic congestion on the internet or at any website, or any combination thereof. The Releasees further assume no liability for any injury or damage to a participant’s or any other person’s computer or other property related to or resulting from participating in the Event, or from accessing or downloading any material relating to the Event.

32. Release. Nothing in these Rules and Regulations limits or excludes any liability of the Releasees for death or personal injury caused by their negligence, or for fraud or any other liability that cannot lawfully be limited or excluded. Subject to the foregoing, by participating in the Event, all participants (and their parent/legal guardian if participant is a minor in their jurisdiction of residence) agree to release and hold harmless the Releasees from any injury, loss or damage of any kind to persons or property, including but not limited to death, resulting in whole or in part, directly or indirectly from participation in any Event-related activities or from the acceptance, receipt, possession, use or misuse of any Prize or portion of any Prize. The Event activities are designed to be enjoyable and safe, but there is always a potential for danger; participants recognize and accept that by participating in the events, they may suffer bodily injury up to and including death.

CONSENT TO COLLECTION AND USE OF PERSONAL INFORMATION

33. By participating in the Event and voluntarily providing personal information including, but not limited to, name, address and telephone number (“Registrant Information”), each participant grants permission to Boys and Girls Clubs of Canada and to its affiliates to collect and use the Registrant Information to administer the Event and award the Prizes, and for any other purposes required or permitted by law, in accordance with our privacy policy, which is available for review on the Boys and Girls of Canada website.

Rules and Regulations for Quebec

The goal of the Capital One® Race for Kids™ is for participants and teams to enjoy themselves while taking part in a unique national fundraising event for Boys and Girls Clubs of Canada. This adventure race will allow participants to return to the best adventures of their childhood, to embrace the carefree days of being a kid, and to bond as a team as they challenge their skills while raising funds for all boys and girls to have the same opportunity. Participants are required to abide by the Rules and Regulations of the event provided below.


The Event and each Race (as defined below) are administered by Boys and Girls Clubs of Canada. There is a suggested registration fee of between $10 to $50 per participant, as determined by each Local Club (as defined below). In addition, to be eligible to win a Race and to receive Race-related prizes, each team must have raised and contributed to the Capital One Race for Kids event registration site a minimum suggested fundraised amount between $360 and $500. The exact amount of the suggested registration fee and suggested fundraising amount for each Race will be published on the website of each Local Club no later than January 6, 2016. See Sections 11 through 15 for further details and for how to register and be eligible to win prizes without paying this fee and raising the suggested fundraising amount. Each Local Club will have the option of administering a random draw for additional prizes.  See Section 20 for more details about random draws, and see Sections 19 and 21 for further information on how to be eligible to win additional fundraising-based prizes.

RULES & REGULATIONS - Quebec


1. Date, Time, and Location of Race. The Capital One Race for Kids will take place on one of the following dates: May 21, 2016; May 28, 2016; June 4, 2016; or June 11, 2016 (each, an “Event Day”) in various cities and towns across the province of Quebec where the local Boys and Girls Clubs of Canada chapter (each, a “Local Club”) is promoting the race (each being a “Race”).  The specific date, time and location of each Race will be published on the website of each Local Club no later than January 6, 2016. On Event Day, each Local Club may hold a random draw for Prizes specific to the Local Club’s Race, as further described under Section 20 below (each being a “Random Draw”). Additional fundraising-based prizes may be awarded, as further described under Section 21 below. Throughout these Rules and Regulations, the Races, any applicable Random Draws and any applicable fundraising-based prize selections or draws are referred to collectively as the “Event”, and prizes awarded to the winner(s) of or participants in a Race, to winner(s) of a Random Draw (where applicable), and to winner(s) of fundraising-based prizes are referred to as “Prizes”.


2. Checkpoint Challenges. Each Race consists of 10-15 tasks at a specified locations (each, a “Checkpoint Challenge” or “Challenge”), of which each team of four validly registered and eligible Race participants (a “Team”) must complete at least 10 (including any Challenges specified to be mandatory Challenges) prior to crossing the finish line. Teams must decipher a clue (a “Checkpoint Clue”) to determine the location of each Checkpoint Challenge. Checkpoint Challenges may consist of a small puzzle or task that each Team will need to successfully complete, as determined by the Capital One Race for Kids official(s) (each, an “Official”) present at each Challenge, in order to receive a token certifying completion of the Challenge (a “Checkpoint Token”). In order to win a Race, all 4 Team members must be the first to reach the finish line with at least 10 Checkpoint Tokens in hand (including all Checkpoint Tokens from any Challenges specified to be mandatory Challenges) and must have correctly solved the Capital One Race for Kids Final Puzzle (the “Final Puzzle”).


3. Tie-Breakers. In the case of a tie at the conclusion of a Race, an Official may assign a tie-breaking challenge to the tied Teams. The winner of any tie-breaking challenge (as determined by the Official in their sole and absolute discretion) will be the winner of the tie and of the applicable Race.


4. Travel. Travel in the course of a Race is only permitted by foot or public transit. Teams are not permitted to use any alternative mode of transportation during a Race. The only exception to this rule is if a Local Club event organizer explicitly designs a Checkpoint Challenge to include operation of a vehicle, in which case the Team shall be permitted to utilize alternative methods of transportation solely for the purpose of completing, or attempting to complete, such Challenge. Teams must stay together at all times during a Race and must complete each Challenge as a team unless otherwise instructed by an Official.    
5. Race Bibs. Participants must wear any official Capital One Race for Kids bib numbers at all times (unless instructed otherwise by the Officials) in such a way that it, and any printing on it, is visible at all times.


6. Checkpoint Challenges. All four members of a Team must be present at the Checkpoint Challenge location before beginning the Challenge.  If there is more than one Team at a Checkpoint Challenge location, the teams will complete the Challenge on a first-come, first-served basis. An exception will be made in the event that a Team has a Race Advantage as further described in Section 10.


7. Assistance. Participants may not accept physical help, transportation, assistance, support, guidance and/or contributions of any kind towards the completion of a Race, individual Checkpoint Challenges, and the Final Puzzle from any persons other than their Team members, or as expressly permitted in these Rules & Regulations or by an Official.


8. Issues with Challenges. The Releasees (defined below) will not be held responsible for any Checkpoint Challenge deemed to be offensive to Teams or participants. Failure to participate in any Checkpoint Challenge will result in the Team being required to sit out a time penalty or disqualification from a Race, as determined by the Official in their sole and absolute discretion. In the event a Checkpoint Challenge experiences a technical, mechanical or other issue that prevents the completion of the Challenge by any Team, the Official may, in their sole and absolute discretion, require a Team to sit out a time penalty as substitute for completion of the Challenge.


9. Participant Conduct. All participants must obey all laws, regulations, bylaws and rules of the road and comply with the directions of the Officials, authorities and property/venue owners. The Releasees (defined below) are not responsible for the actions of participants during the course of a Race.


RACE ADVANTAGES

10.  There are three types of race advantages that Teams may earn: a Checkpoint Bypass Card, a Head Start or a Final Puzzle Clue (each a “Race Advantage”). The Race Advantage(s) available at each Race may vary, and will be published on the website of each Local Club no later than March 1, 2016. Teams may be provided with a card evidencing their receipt of a Race Advantage. Race Advantage cards must be kept in the possession of each Team for the duration of a Race or until surrendered at a Checkpoint Challenge. In addition, each Local Club may offer additional benefits before, during or after a Race to Teams that achieve a certain fundraising target (“VIP Benefits”), provided that VIP Benefits shall not confer an advantage on any team in completing or winning a Race. Eligibility and benefit of each Race Advantage and VIP Benefits are as follows:


10(a) Checkpoint Bypass Card


Eligibility:  Each Team achieving a team fundraising target of $1,000 will be awarded a Checkpoint Bypass Card.

Advantage:  An Official will allow a Team that presents a Checkpoint Bypass Card to advance to the front of the line at any one Checkpoint Challenge location. Teams must relinquish their card to the Official at that location to use this Race Advantage.  If one Team holding a Checkpoint Bypass Card arrives at a particular Checkpoint Challenge location while another Team with a Checkpoint Bypass Card is already there and both Teams attempt to use their Checkpoint Bypass Card at that particular location simultaneously, the Teams will advance to the front of the line in the order they arrived at the Checkpoint Challenge location. For example, if two Teams arrive at a Checkpoint Challenge location and both Teams attempt to utilize their Checkpoint Bypass Card, the second Team to have all four Team members arrive at the Checkpoint Challenge location will not be allowed to proceed ahead of the first Team who arrived at the Checkpoint Challenge location and used a Checkpoint Bypass Card.


10(b) Head Start


Eligibility: One Head Start will be given to Teams for reaching specific fundraising targets. The range of fundraising targets for each Head Start are set out below; the specific fundraising targets to earn a Head Start for each Race will be published on the website of each Local Club no later than March 1, 2016.

I.    $750 or $1,000 fundraised dollars = 1 minute
II.    $1,000 or $1,500 fundraised dollars = 3 minutes
III.    $1,500 or $2,000 fundraised dollars = 5 minutes

Advantage:  At the start of each Race, teams meeting the minimum fundraising targets as provided on the website of each Local Club will be given a corresponding head start on such Race. Head Starts are not cumulative, and each team is limited to using only one Head Start during each Race.

10(c) Final Puzzle Clue

Eligibility: Teams meeting a minimum fundraising target of $1,000 will be given a Final Puzzle clue.

Advantage: At the end of each Race, the clue may help Teams solve the Final Puzzle.

10d) VIP Benefits


Eligibility: Teams meeting a minimum fundraising target of $2,500 will receive VIP Benefits on the Event Day. VIP Benefits shall be determined at the sole discretion of the Local Club for each Race, and may include, but are not limited to, the following:


I.    Access to an exclusive VIP lounge at the location of the Race;
II.    Access to a separate VIP registration area prior to the Race;
III.    Enhanced and/or free food options for Team members;
IV.    Race-related accessories, such as sun visors or bandanas;
V.    Customized Race jerseys;
VI.    Acknowledgement of teams that have achieved the VIP Benefits fundraising target during speeches and presentations;
VII.    Receipt of, or eligibility to win, a special trophy designated for Teams that have achieved the VIP Benefits fundraising target; and
VIII.    Complimentary alcoholic beverages at a Race after-party.


The approximately retail value of VIP Benefits for each eligible Team will be $100. Actual VIP Benefits available at each Local Club will be published on the website of each Local Club no later than March 1, 2016.


Advantage: VIP Benefits shall confer no advantage to Teams in completing or winning a Race.


HOW TO REGISTER


11. Eligibility Requirements and Registration Donation. To be eligible to participate in a Race, participants must be a legal resident of Canada and of the province of Quebec, and must be eighteen (18) years of age or older on the Event Day. All participants must agree to and submit an Assumption of Risks, Waiver of Claims, Release and Indemnification Agreement (“Release”) to Boys and Girls Clubs of Canada. The Release is made available to participants at the time of registration, and must be agreed to and submitted at that time. Participants must register as a Team of four (4) eligible participants. If any member of a Team is absent on Event Day, the remaining Team members may still participate in a Race, but will be ineligible to win any Race-related Prizes. Alternatively, if a Team member is absent on Event Day, a Team may substitute in a new Team member, provided that (i) such substitute Team member must be eligible to participate in the Race, subject to the eligibility requirements set out above, and (ii) such substitute Team member must submit a signed copy of the Release to Boys and Girls Clubs of Canada prior to participating in the Race. Participants must raise and submit a combined non-refundable registration fee of $40-$200 per Team ($10-$50 per Team member), or each participant must submit a No Purchase Registration as described below. Registration must be submitted using the Boys and Girls Clubs of Canada website and all registrations must be complete by at least one hour before the applicable Race starts (in your local time zone), or by 12:00:01 pm (in your local time zone) on May 14, 2016 in the event of a No Purchase Registration, to be eligible to participate in the Race. Teams that substitute a new Team member will not be required to submit an additional registration fee or an additional No Purchase Registration as described below for the substitute Team member, provided that the original Team member who is being substituted has previously completed such registration. Teams that include substitute Team members will continue to be eligible to win Race-related Prizes.


12. No Purchase Registration. To register to participate in a Race without submitting a registration donation or raising the minimum fundraising amount (as detailed in Section 15(a) below), each member of a Team may submit a unique and original minimum 100 word essay on the subject of “The importance of the services provided by the Boys and Girls Clubs of Canada”.  The essays may be mailed or hand delivered to the Local Club or emailed to raceforkids@bgccan.com.  All essays must be received no later than 12:00:01 pm (in your local time zone) on May 14, 2016.


13. Promotional Codes. The Boys and Girls Clubs of Canada may in its sole and absolute discretion, publish a promotional code or codes, which offer participants the opportunity to register for a Race with a reduced or waived registration fee.  In the event this option is exercised, the effect of the promotional code, the conditions associated with its use, and the deadline for registering using it will be published with the promotional code. A promotional code must be submitted at the time the participant registers to be valid. Any participant that registers using a promotional code or codes shall not be entitled to a refund or credit in the event another promotional code is published or otherwise made available that reduces or waives the registration fee in any amount greater than the original promotional code used by such participant when they registered for a Race. In order to win a Race or be eligible to receive any Race-related Prizes, teams with participants making use of a promotional code must have raised and contributed to the Capital One Race for Kids event registration site the minimum suggested fundraising amount specified in section 15(a) below. 


14. No Refund. Any donations made to a Team (and donations made by such Team members) that chooses not to compete in a Race, does not raise the minimum suggested amount and submit the required registration fee, or does not register via the No Purchase Registration option, or a team disqualified under these Rules & Regulations, will not be eligible for refunds.


15. Prize Eligibility. To be eligible to win a Race and receive Race-related Prizes:


(a) the Team must have raised and contributed to the Capital One Race for Kids event registration site a minimum suggested fundraised amount between $360 and $500 (in addition to the registration fee  detailed above). The exact minimum suggested fundraised amount for each Race will be published on the website of each Local Club no later than January 6, 2016. Alternatively, the Team must have submitted a No Purchase Registration as described above;

(b) all four (4) Team members must be present and have participated in the Race from the start line to crossing the finish line and completing the Final Puzzle;

(c) the Team must present 10 Checkpoint Tokens (including all Checkpoint Tokens from any Challenges specified to be mandatory Challenges);

(d) the Team must be confirmed by the event Officials as having completed at least 10 Challenges (including any Challenges specified to be mandatory Challenges); and

(e) the Team must solve the Final Puzzle within the duration of the applicable Race.

Notwithstanding the foregoing, employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Boys and Girls Clubs of Canada or any Local Club are not eligible to win any Prizes.

DISQUALIFICATION FROM RACE


16. Disqualification. The Boys and Girls Clubs of Canada and the Officials reserve the right to disqualify any Team or participant engaging in any behaviour contrary to these Rules & Regulations. This includes Teams or participants that are acting in unsportsmanlike or illegal behaviour, are endangering their personal safety and well-being, or the safety and well-being of competing Teams or the general public, all as determined by the Officials in their sole and absolute discretion. If a participant is disqualified, their entire Team will also be disqualified and will not be permitted to continue competing in the applicable Race, or be eligible to receive any Race-related Prizes.


17. Confidential Knowledge. In the sole and absolute discretion of the Boys and Girls Clubs of Canada and the Officials, any person with confidential knowledge concerning a Race is NOT eligible to win that Race or to win any Race-related Prizes.


18. Amendment. Boys and Girls Clubs of Canada and the Officials reserve the right, subject to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) if applicable, to end, postpone or amend a Race, to amend or change these Rules and Regulations, or disqualify any participant(s), if for any reason they believe that participants or Teams may not be able to safely complete a Race, or for any other reason.

MYSTERY BOX CHECKPOINT

19. Local Clubs may offer an additional “Mystery Box” Checkpoint Challenge (a “Mystery Box Challenge”). Where offered by a Local Club, the Mystery Box Challenge is optional to participating Teams and completion of the Mystery Box Challenge is not required to win a Race or to receive any Prize other than a Mystery Box Checkpoint Prize.  Teams will be provided with a clue as to the location of the Mystery Box Challenge at the same time they are given the clues for the other Checkpoint Challenges. If they so choose, each Team has the option to make their way to the Mystery Box Challenge. Upon arrival they may complete a Challenge similar to those at each of the other Checkpoint Challenges. Upon successful completion of the Mystery Box Challenge, such Teams may take one key from a bucket filled with keys. One key in the bucket will open a locked box at the Local Club’s after-party. The Team whose key opens the lock will be awarded all the contents contained therein (subject to one Team member correctly answering the mathematical skill-testing question).  If none of the Teams’ keys opens the locked box, the prize will be forfeited.  The approximate value of the contents will be published on each Local Club’s website no later than March 1, 2016, where applicable.  Chances of winning a Mystery Box Checkpoint prize depend on the number of keys in the bucket at the applicable Race and the number of participant Teams that successfully complete the Mystery Box Challenge at that Race.   

ELIGIBILITY FOR RANDOM DRAW

20. Each Local Club has the option of conducting a Random Draw to select the winners of a Prize or Prizes, the number, description and value of which will be published on the Local Club’s website no later than March 1, 2016 (a “Random Draw”). Participants in the Capital One Race for Kids who registered for the Race by any method described in sections 11 through 13 of these Rules and Regulations are automatically entered into a Random Draw, if offered by a Local Club. There is no purchase necessary to enter. The Random Draw will occur during the course of the Race and winners will be announced at the after party.  The precise time and location of the after party will be published on the Local Club’s website no later than March 1, 2016. Chance of winning a Random Draw depends on the number of eligible participants registered with each Local Club.

PRIZES

21.  The number, value and types of Prizes available to be won for each Race, and the time and location of the announcement of the selected participants will be published on the website of each Local Club no later than March 1, 2016.  The number, value and types of Prizes available to be won for each Race may vary. Chances of winning a Race prize depend on the number, skill, and speed of the participants at each Race.

In addition, the following fundraising Prizes will be awarded following the Event:

Capital One Race for Kids 2016 Early Registration Prize

One Team consisting of four participants will be selected from all eligible Teams for all Races by random draw to receive an Early Registration Prize.

In order to be eligible to receive this Prize, a Team must
(a) have all four (4) Team members successfully register to participate in a Race via the methods described in sections 11 to 13 above prior to March 1, 2016 at 11:59:59 pm Local Time;
(b) raise the minimum fundraising amount of $360-$500 as further detailed in Section 15(a) above prior to March 1, 2016 at 11:59:59 pm Local Time; and
(c) attend and compete in a Race with all four Team members present.

The selected Team will be eligible to receive two (2) travel vouchers from WestJet Airlines Ltd., with a retail value of $2,500 per voucher. The total retail value of the Early Registration Prize is $5,000. The voucher(s) are subject to the terms placed on them by their issuer. The voucher(s) cannot be exchanged or substituted for another prize of equal or lesser value, including cash. Chances of winning the Early Registration Prize depend on the number of eligible participant Teams registered for all Races that meet the eligibility criteria described above.


Capital One Race for Kids 2016 Fundraising Prize

One (1) Fundraising Prize will be awarded to the participant that raises the highest fundraising total for each Race at each Local Club by 11:59:59 pm Local Time on the day preceding the Event Day for each Race. The highest fundraising participant will be eligible to receive a travel voucher or vouchers for one flight for two people from WestJet Airlines Ltd., with a retail value of $2,500. The voucher(s) are subject to the terms placed on them by their issuer. The voucher(s) cannot be exchanged or substituted for another prize of equal or lesser value, including cash.  Chances of winning a Fundraising Prize depend on the number and fundraising skill of participants in each Race.

WINNER’S SELECTION, RELEASE & FULFILLMENT

22.  Participants who have won a Race or otherwise been selected to receive a Prize will be announced at the after party for each Race, the location and time of which will be published on each Local Club’s website no later than March 1, 2016.  Before being confirmed as a winner and awarded a Prize, selected participants must:

(a) correctly answer a time-limited mathematical skill-testing question without help, mechanical or otherwise;

(b) sign a liability and publicity release form in a form acceptable to Boys and Girls Clubs of Canada;

(c) provide proof of age and residency, in a form acceptable to Boys and Girls Clubs of Canada; and

(d) certify compliance with these Rules & Regulations, as applicable.

If a selected participant is not present at the after party, the Local Club, acting reasonably, will attempt to contact the selected participant at the telephone number provided on their Race registration within two (2) business days after the announcement at the after party or date of the Prize draw, whichever is later. In the event a selected participant cannot be contacted within two (2) business days, he or she will be disqualified and an alternate participant will be selected in accordance with these Rules and Regulations. Selected participants who are not present during the after party, and who are contacted successfully by the Local Club, must attend at the applicable Local Club, complete the requirements set out under this Section 22, and retrieve their Prize in person at the Local Club during the week following the announcement or notification of their eligibility to receive such Prize. 

23. Release Form. The liability and publicity release forms will be provided to the selected participant at the after party, or otherwise in person at the applicable Local Club or via electronic means if the selected participant is not present at the after party. If the liability and publicity release forms are not signed and returned within five (5) days from the time that the Local Club provides them to the selected participant, if the skill-testing question is not answered correctly or if the Prize is declined, the Prize will be forfeited.  Boys and Girls Clubs of Canada reserves the right to select another eligible participant (and the requirements above will apply to the newly selected participant) or to cancel the Prize.

24. Publicity Rights & Release. Before being confirmed the winner of any Prize, each selected participant may be asked to correctly answer a time-limited mathematical skill-testing question without any mechanical or other assistance.  By virtue of participating in a Race, or by accepting any Prize, each participant permits Boys and Girls Clubs of Canada and any Capital One Race for Kids sponsors to use their name, city of residence and photograph and/or video image in any publicity or advertising with no additional compensation. Each participant further releases Boys and Girls Clubs of Canada, Capital One Race for Kids sponsors and their respective agents, officers, directors, employees and representatives from any and all liability damages, costs, expenses and claims arising out of or related to the Race or any Prize. The Releasees (defined below) are not responsible for any distribution of any Prize between the participants on a winning Team. 

25.  Prize Details & Substitution. All dollar amounts mentioned are Canadian dollars. The winners must accept the applicable Prize as given. Prizes are not transferable.  If a winner of any Prize does not pick up the Prize on Event Day, the Prize must be picked up by the winner from the Local Club in the week following the Event.  In the event that all or any component of a Prize is unavailable, Boys and Girls Clubs of Canada reserves the right to substitute the Prize or Prize component with one of equal or greater value. Neither Boys and Girls Clubs of Canada nor any of the Releasees (defined below) will be responsible if any factors beyond its reasonable control prevent any Prizes from being fulfilled. Boys and Girls Clubs of Canada is not responsible for providing insurance, financial or tax advice.

26. Prize Conditions. Prize winners are solely responsible for all costs not expressly described as being part of the Prize. In other words, if applicable, all costs associated with taxes, fuel/currency surcharges, ground transportation, meals, beverages, room service, gratuities, merchandise, telephone calls, taxis, required or recommended travel documentation, insurance, personal expenses of any kind or nature, and any applicable overnight layover are excluded.  Any flight and hotel reservations are subject to availability, additional restrictions and blackout dates. The Releasees (defined below) are not responsible for any delay, postponement, suspension, unavailability, rescheduling or cancellation, for any reason, of any flights or hotels, and the Releasees (defined below) will not compensate the Prize winner(s) in the event of any of the above. If applicable, the Prize winner(s) must travel within one year of being declared a winner, or risk forfeiting the Prize. If applicable, the winner(s) must have all necessary documentation to permit international travel (passports, visas etc.), and may not have any barrier to entry into their country of destination, or re-entry into Canada. If a winner does not utilize any part(s) of the Prize, then any such part(s) not utilized will be forfeited in its entirety and nothing will be substituted in its place. Boys and Girls Clubs of Canada and Capital One Race for Kids sponsors reserve the right at any time to place reasonable restrictions on the availability or use of a Prize or any component thereof. By accepting a Prize, the winner(s) and any travel companions agree to waive all recourse against the Releasees (defined below) if any Prize or a component thereof does not prove satisfactory, either in whole or in part. Neither Boys and Girls Clubs of Canada nor Capital One Race for Kids sponsors will replace any lost or stolen tickets, vouchers, certificates or gift cards.

INTERRUPTIONS

27. It is expressly understood that each Race may be filmed for promotional purposes including broadcast on television. In an effort to accommodate the execution/planning/filming of the Event, it may be necessary for the Officials to (i) augment these Rules and Regulations with verbal or written instructions during the Event, (ii) delay the start of, or interrupt and restart, any given challenge, or (iii) otherwise amend or intervene in the operation of the Event or any Race. The Officials shall, in their sole and absolute discretion, make reasonable efforts to ensure that, if there is any positive or negative impact to a team’s performance caused by such amendments or interventions, such impact will be equally balanced among all teams.

ADDITIONAL TERMS & CONDITIONS

28. Compliance with Rules. Participation in the Event requires all participants to abide by these Rules and Regulations. Participants who do not comply with these Rules and Regulations may be subject to disqualification, in the sole and absolute discretion of the Officials or Boys and Girls Clubs of Canada. Boys and Girls Clubs of Canada reserves the right to disqualify any entrant whose character or conduct, if declared to be the winner, could bring the reputation of the Capital One Race for Kids, its sponsors or the Boys and Girls Clubs of Canada into disrepute. Boys and Girls Clubs of Canada reserves the right, subject to the approval of the Régie, if applicable, to modify the Rules and Regulations in any way at any time it deems necessary or appropriate without materially affecting the terms and conditions of the Capital One Race for Kids.

29. Amendment, Suspension and Cancellation. Boys and Girls Clubs of Canada, with the consent of the Régie if applicable, reserves the right to withdraw, amend or suspend the Event or any Race (or to amend these Rules and Regulations) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of Boys and Girls Clubs of Canada that interferes with the proper conduct of the Event or any Race as contemplated by these Rules and Regulations. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Event or any Race in any way (as determined by Boys and Girls Clubs of Canada in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, Boys and Girls Clubs of Canada, with the consent of the Régie if applicable, reserves the right to seek remedies and damages to the fullest extent permitted by law. Boys and Girls Clubs of Canada reserves the right to cancel, amend or suspend the Event, or any Race or to amend these Rules and Regulations, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Boys and Girls Clubs of Canada reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

30. Adjustment. Boys and Girls Clubs of Canada reserves the right, in its sole and absolute discretion, with the with the consent of the Régie if applicable, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules and Regulations, to the extent necessary, for purposes of verifying compliance by any entrant with these Rules and Regulations, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of Boys and Girls Clubs of Canada, in its sole and absolute discretion, affect the proper administration of the Event as contemplated in these Rules and Regulations, or for any other reason.

RELEASE OF LIABILITY

31. Disclaimer. Boys and Girls Clubs of Canada, Capital One Bank (Canada Branch), Capital One Race for Kids sponsors, their affiliates, Prize providers and all of their directors, officers, employees, agents, as well as their respective advertising and promotional agencies (collectively, the “Releasees”) assume no responsibility for late, lost, stolen, destroyed, misdirected, illegible or otherwise indecipherable registrations, for any failure or technical malfunction of any website, telephone networks, online computer systems or equipment, servers, access providers or software, poor reception or technical problems, human error or traffic congestion on the internet or at any website, or any combination thereof. The Releasees further assume no liability for any injury or damage to a participant’s or any other person’s computer or other property related to or resulting from participating in the Event, or from accessing or downloading any material relating to the Event.


32. Release. Nothing in these Rules and Regulations limits or excludes any liability of the Releasees for death or personal injury caused by their negligence, or for fraud or any other liability that cannot lawfully be limited or excluded. Subject to the foregoing, by participating in the Event, all participants agree to release and hold harmless the Releasees from any injury, loss or damage of any kind to persons or property, including but not limited to death, resulting in whole or in part, directly or indirectly from participation in any Event-related activities or from the acceptance, receipt, possession, use or misuse of any Prize or portion of any Prize. The Event activities are designed to be enjoyable and safe, but there is always a potential for danger; participants recognize and accept that by participating in the events, they may suffer bodily injury up to and including death.

CONSENT TO COLLECTION AND USE OF PERSONAL INFORMATION

33. By participating in the Event and voluntarily providing personal information including, but not limited to, name, address and telephone number (“Registrant Information”), each participant grants permission to Boys and Girls Clubs of Canada and to its affiliates to collect and use the Registrant Information to administer the Event and award the Prizes, and for any other purposes required or permitted by law, in accordance with our privacy policy, which is available for review on the Boys and Girls of Canada website. 

REGIE

34. If applicable, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
